CONTEST RULES AND REGULATIONS

 

  1. CONTEST PERIOD

The “Win a Traeger” Contest (the “Contest”) is sponsored by Jay-Lor Fabricating Inc. also referred to in this document as “Jaylor” (the “Sponsor”) Contest entries will be accepted from March 9, 2024 at 6:00 am Eastern Time (“ET”) to April 7, 2024 at 11:59 p.m. ET, (the “Contest Period”).

 

  1. CONTEST GROUP

For the purposes of the Contest, the “Contest Group” is composed of the Sponsor, together with its advertising and promotion agencies, suppliers of material and services related to the Contest, and any other corporation, partnership, sole proprietorship or other legal entity to the benefit of which this Contest is held, as well as their respective officers, directors, employees, agents, and other representatives.

 

  1. ELIGIBILITY

The Contest is open to all individuals who (each, a “Participant”): (a) reside in Canada (excluding Quebec); and (b) have reached the age of majority in their province or territory of residence. Employees, agents and other representatives of the Contest Group, as well as any person with whom they reside, are not eligible to enter the Contest. By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these official Contest Rules and Regulations (the “Rules”).

 

  1. METHODS OF ENTRY

4.1. No purchase necessary. To enter the Contest and receive one (1) Entry (defined below) you must complete the required task set out below (the “Required Task”) . Up to a maximum of one (1) Required Task can be completed by each Participant. To complete the Required Task, you must complete the mandatory fields provided. Upon completing a Task in accordance with these Rules (determined at Sponsor’s sole discretion), you will obtain one (1) entry in the Contest (an “Entry”). At the end of the Contest Period, all Entries will be gathered for the Random Draw to select a Potential Winner (see Section 6 for details on the Ways to Win/Odds of Winning).

Required Task
Fill out a paper ballot or a digital ballot and submit the ballot. All fields on the ballot must be filled in and complete with accurate and true information for the ballot to be deemed valid and the ballot be counted as an entry. Upon completing all of the foregoing requirements, during the Contest Period in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion), you will receive one (1) Entry.

4.2. No purchase is required in order to participate in the Contest.

  1. PRIZES:

The following prize (a “Prize”) is available in the Contest:

  1. One (1) “Grand Prize”is available to be won by one (1) Participant. The Grand Prize includes: one Traeger Tailgater which has been customized with custom Jaylor graphics. This grand prize can not be further changed or customized by the contest winner.

Approximate value of the Grand Prize is $700.00 CAD each.

  1. WINNER SELECTION/NOTIFICATION/ODDS OF WINNING:

NOTE – to be a qualified Entrant, all MANDATORY fields of the entry form must be completed. EACH PARTICIPANT IN THE CONTEST MUST COMPLETE at least 1 task and entry form to GAIN AN ENTRY, UP TO A MAXIMUM OF 1 entry total per participant. See section 4, for detail on method of entry. NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS A WINNER IN ACCORDANCE WITH THESE RULES.

  1. Random DRAW Grand Prize Winner

On April 8, 2024 in Ontario at approximately 12:00 p.m. ET, one (1) Entry will be randomly drawn from all eligible Entries received to select the potential Grand Prize winner.

A representative of the Sponsor acting reasonably, will attempt to contact the potential Grand Prize winner selected from the draw by email within five (5) business days after the draw to notify the potential Grand Prize winner. Three (3) attempts to contact the potential Grand Prize winner will be made (within and outside of business hours ET). Proof of identification must be provided upon request. A mathematical skill-testing question needs to be answered correctly, and a completed Declaration and Release document needs to be received by the Sponsor, in order to be declared the Winner.

In the event that the potential Grand Prize winner (a) cannot be contacted within five (5) business days after the draw, or if there is a return of a notification as undeliverable; (b) fails to correctly answer the skill-testing question; (c) fails to return the properly executed Contest documents within the specified time; (d) cannot accept (or is unwilling to accept) the Grand Prize (as awarded) for any reason; and/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then they will be disqualified and an alternate potential winner will be drawn at the Sponsor’s sole discretion.

ODDS OF WINNING: The odds of winning the Grand Prize will depend on the total number of Entries received during the Contest Period.

  1. AWARDING OF PRIZES

7.1. To be declared a “Winner”, a selected entrant must, in addition to meeting the Contest eligibility criteria and otherwise complying with the Contest Rules, first: be reached by email, phone or met in person by the Sponsor or its representatives as set out above; have correctly answered a mathematical skill-testing question; sign and have witnessed the Declaration and Release documentation and return it to the address indicated in the documentation within seven (7) days following its delivery by the Sponsor or its representatives. The completed Declaration and Release form can be photographed or scanned and returned to afoster@jaylor.com. The completed Declaration and Release form can be given in person to the Sponsor or its representatives as set out above .

 

7.2. Disqualification: If any one of the conditions mentioned in the Rules is not met, the selected entrant will be disqualified and shall not be entitled to receive any Prize, and the Administrators reserve the right, in their sole and absolute discretion, to select at random another eligible entrant as a potential Prize winner or to cancel the applicable Prize.

7.3. Delivery of Prize: Following receipt of a selected entrant’s correctly answered mathematical skill-testing question and signed Declaration and Release documentation, the Administrators will make arrangements with the winner for them to receive their prize. The winner may need to meet the sponsor or its representatives at a prearranged location in order to pick-up their prize. Photos and potentially videos of the winner receiving their prize are required and a release document allowing for this must be signed as a part of the Declaration and Release form. Please allow up to 12 weeks for delivery. The winner hereby agrees to comply with all Prize delivery and/or pick-up requirements and procedures that may be communicated to them by the Sponsor, upon returning their signed release form (including, without limitation, requirements to provide a signature at the time of delivery). Sponsor is not responsible for Prizes following shipping and shall not assume any liability for a lost, damaged or misdirected prize.

  1. GENERAL TERMS AND CONDITIONS

8.1. Verification of Entries: The validity of any Entry is subject to verification by the Sponsor. Any Entries that are illegible, incomplete, fraudulent or otherwise non-compliant with the Rules, will be disqualified. Any entrant or other individual who enters or attempts to enter the Contest in a manner that is contrary to these Contest Rules or that is otherwise disruptive to the proper operation of the Contest or by its nature is unjust to other entrants or potential entrants will be disqualified. All decisions made by the Sponsor or its representatives, including without limitation those concerning the eligibility or disqualification of entrants, are final and binding without right of appeal. All Entries become the property of the Sponsor and none will be returned.

8.2. Acceptance of Prize: Prize must be accepted as described in these Contest Rules and cannot be returned, transferred to another individual, substituted for another prize or exchanged in whole or in part for money. All characteristics and features of the Prize, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion. The Prize winner is solely responsible for all costs not expressly described herein.

8.3. Number of Prizes/Winners: By entering the Contest, each entrant acknowledges that the Sponsor shall not be required under any circumstances to award more Prizes than the number of available Prizes, as set out in these Contest Rules. In the event that, for any reason whatsoever (including, without limitation, as a result of an error, malfunction or defect in the design, advertising, management, implementation or administration of the Contest, whether mechanical, electronic, human or otherwise) the number of declared winners or the number of Prizes claimed by entrants is greater than the number of Prizes available, the Sponsor reserves the right, in its sole and absolute discretion, to end the Contest in whole or in part, without notice.

8.4. Other Changes to Contest Rules: Without limiting the provisions of Rule 8.3 above, the Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, terminate or suspend the Contest, in whole or in part, in the event of any cause or circumstance, including, without limitation, any virus, computer bug or unauthorized human intervention or any other cause that is beyond the control of the Sponsor, that could corrupt or affect the administration, security, impartiality or normal course of the Contest. Without limiting the foregoing, the Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for purposes of verifying compliance of any entrants, Contest-Related Information and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

8.5. Release and Exclusion of Liability: By the Entrants: By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees: (i) to release, discharge, and forever hold harmless the Contest Group and their respective shareholders, officers, directors, employees, agents, representatives, successors and assigns (the “Released Parties”) from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant’s participation or attempted participation in the Contest, compliance or non-compliance with these Contest Rules and acceptance and use or misuse of any Prize. Any entrant selected for a Prize acknowledges that upon awarding of the Prize, (i) the obligations typically borne by the provider of services or goods become that provider’s responsibility; and (ii) if selected as a potential winner, to sign the declaration and release documentation (see Rule 7.1) in this regard before receiving his/her Prize. The Released Parties will not be responsible for lost, incomplete, late or misdirected entries or for any failure of the Contest website, if applicable, during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting death, injury or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution

8.6. Personal Information: By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted for the purpose of administering the Contest and in accordance with Jay-Lor Fabricating Inc.’s privacy policies (https://jaylor.com/terms-conditions-privacy-policy/) By agreeing to enter the Contest the entrants agree to communications by the Sponsor not limited to email, digital marketing, and phone calls. Posting of the Winners’ names, city/town location and province will be posted by Sponsor on Jaylor’s digital and social media platforms, as well as any photos or videos of the Winner to be determined by the Sponsor. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

8.7. Identity of the Entrant: For the purposes of these Contest Rules, the entrant is the person who completed the entry form to enter the Contest. It is to this individual that the Prize will be awarded if selected and declared as a winner.

8.8. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, e-mail addresses and/or use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt the Contest; and/or (iii) disrupt or participate in the Contest in any other fraudulent or misleading way, then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Released Parties are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entries, Entry Forms, Tasks and/or any other Contest-related information (collectively, “Contest-Related Information”), all of which are void. All Contest-Related Information and entrants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) for any reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, the Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein.
